DEFINITION AND OBJECT OF THE CONTRACT
1.1 - This contract ("Contract") is a distance contract pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable property between the de Laurentiis company, with registered office in: Via Nuova Benvenuto Cellini, 4 - 80128 Naples and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by the de Laurentiis company of a purchase proposal issued by the Customer by telephone or via the internet, following the invitation to offer content on the shopdelaurentiis.com website (the " Site ") and / or through other distance selling systems of the de Laurentiis company, on the basis of the methods described in article 3 below. 1.2 The present general conditions of sale (" General Conditions ") and, in particular, the information of referred to in art. 52 of the Consumer Code, as provided by de Laurentiis on the phone to the Customer and reported on the Site, will remain valid and effective until they are modified and / or integrated by de Laurentiis itself. Any changes and / or additions to the General Conditions will be effective from the date on which they will be communicated to the public and will apply to sales made from that date. The latest updated version of the General Conditions is the one available on the Site.
PRICES
The sales prices of the products illustrated on the Site and / or through any other de Laurentiis S.r.l. distance selling systems are inclusive of VAT. and any other tax. Delivery costs are indicated on the Site and / or through any other de Laurentiis distance selling systems, in the case of a telephone order, repeated to the Customer by the operator.
PURCHASE METHOD
3.1 - The Contract by telephone is finalized by communicating to the Customer (who has contacted de Laurentiis by telephone and formulated, on that occasion, a purchase proposal also providing the operator the data necessary for the registration procedure of their name, purchase order and payment method chosen) that the proposal is accepted. 3.2 - In the event of purchase proposals sent through the Site, the Customer will receive a summary e-mail from de Laurentiis, with which he will be informed that his purchase proposal is being processed and will be deemed accepted, unless otherwise communicated and e-mail or telephone sent by de Laurentiis within 3 (three) calendar days from the receipt of the summary e-mail. Once this term has elapsed, the Agreement via the Internet is to be considered completed.
PRODUCT AVAILABILITY
de Laurentiis accepts customer orders within the limits of the quantities of products required in stock. Therefore, the acceptance by de Laurentiis of the purchase proposal submitted by the Customer is subject to the availability of the products in stock. de Laurentiis undertakes to promptly notify the customer of any unforeseen depletion of stocks due to excess demand or other causes.
WARRANTIES AND ASSISTANCE
For products purchased by the customer, the rules on guarantees and assistance relating to the sale of consumer goods are applicable to de Laurentiis.
CUSTOMER OBLIGATIONS
The Customer declares and guarantees: (i) to be a consumer according to the provisions of art. 3 of the Consumer Code; (ii) to be of age; (iii) that the data provided by the same for the execution of the Contract are correct and true.
PROCESSING AND CONFIDENTIALITY OF PERSONAL DATA INFORMATION PURSUANT TO D.LGS. 196/03
9.1 Pursuant to and for the purposes of the provisions of Legislative Decree of 30 June 2003, n.196 Code regarding the protection of personal data (hereinafter the "Code" ), We inform you that your personal data, supplied and / or acquired subsequently, will be processed by de Laurentiis srl in Italy and abroad, through electronic and manual tools in compliance with the Code and current legislation on privacy.
Purpose of the treatment
The collected data are processed for the following purposes: a. subscribe to the service; b. conclude purchase and sale contracts and carry out their services; c. carry out the obligations necessary to execute the contractual relationship in place; d. send commercial information, advertising, information and promotional material, by any means (e-mail, sms, etc.); is. carry out, also by telephone contact, market research, economic and statistical analyzes in order to verify the correct functioning of the services and their satisfaction; f. to elaborate personalized information about the habit of consumption and the orientation of the interested parties. The provision of data is mandatory for the conclusion of the purchase contract, optional in other cases. Failure to provide data will make it impossible to execute the order placed.
Categories of subjects to whom the data will be transmitted
The processing of the personal data in question, for the purposes set out above, may also be carried out by natural or legal persons, in Italy or abroad, who on behalf and / or in the interest of de Laurentiis Srl provide specific processing services or that carry out related, instrumental or support activities. Therefore, your data may be communicated for the same purposes indicated also to: - anyone who is a legitimate recipient of communications required by law or regulations (such as, for example: offices and public authorities); - anyone who is the recipient of communications necessary in fulfillment of the obligations deriving from the services provided; - third-party companies specialized in the management of commercial and credit-related information (such as, for example, data processing centers, banks, etc.). Your data will also be processed by: - companies and / or collaborators for the management of administrative services that are used to fulfill their legal or contractual obligations; - other subjects (companies, companies, individuals) who collaborate in the realization of the services and purposes indicated, also abroad. These subjects operate as Managers or Officers appropriately appointed and instructed.
Data retention
All the acquired data cannot be used for other purposes besides the ones indicated above and will be kept for the period necessary for their realization. After this deadline, the data will be deleted or transformed into anonymous form. For detailed data on purchases and services, the storage times will not exceed those established by current legislation.
Rights of the interested party
This is without prejudice to your right to exercise at any time the rights referred to in Article 7 (Right to access personal data and other rights) of the Code, in particular: right to access their personal data, request their correction, updating and cancellation if incomplete, erroneous or collected in violation of current legislation, as well as to oppose their treatment for legitimate reasons, by sending a written request to de Laurentiis Srl, via grande Orefici 9 - 80133 Napoli (NA), or directly through the methods indicated on the site on the data access page.
COMPETENT COURT
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will be the responsibility of the Court in which the Customer has his residence or domicile, if located in the territory of the Italian State, or of the Court of Naples, if the Customer has his own residence or domicile abroad.
